How do I file a Statement of Claim form?

A Statement of Claim (UCPR form 3A/3B) can be used to start a civil court case.

Representing yourself? 

To make a claim, you will need to indicate what relief you wish to claim, which is the outcome you desire. It is highly recommended you seek legal advice prior to filing a Statement of Claim and commencing a court action. 

What you need to know

Where the claim is for money, there are two ways to file a Statement of Claim using the Online Registry:

  1. Answer some introductory questions and upload a signed completed form. You can access an approved Statement of Claim form from the UCPR website
  2. Complete all questions online, print, collect the appropriate signatures and then upload a digital copy of the signed form.  

Where the claim is for damages, possession, possession and money or detention of goods, you must prepare a UCPR Form 3A (if you are a legal representative) or UCPR Form 3B (if you are representing yourself). Using the Online Registry, you will be required to answer some introductory questions before uploading a signed completed form. 

How to file a form

  1. Login to the Online Registry
  2. Click the New case tab
  3. Click Statement of Claim (UCPR form 3A/3B)
  4. Follow the prompts to complete the form fields. Help is provided throughout this form and can be viewed by clicking the blue help icons. 
  5. Depending on the type of claim, you will have the option to upload a completed PDF version of the form or fill out the form online.  
  6. Upload any supporting documents as PDF files. A signed affidavit may be required as a supporting document. Note: each PDF can have a maximum file size of 5 MB.
  7. You will be directed to the Payments screen, where you can; 
    • Preview the form as a PDF
    • Edit the form
    • Delete the form
    • Make a payment
  8. Select the form(s) to be paid
  9. Click Next 
  10. Follow the prompts to complete your payment. 

Forms that require payment are not submitted to the Court until the payment has been made. 

After you have filed your form, you will receive an email to confirm your submission. This email will include a tax invoice and copy of your submission which will also be available online via the Online Registry website. 

Next steps

If you opted to serve the Statement of Claim yourself, you must print the court approved form and serve it on the defendant(s). You must wait 28 days from the date of service before any further action can be taken. 

Track the progress of your claim online, by logging in to the Online Registry and searching for the case by party name or case number. Select the case name to see details of parties and representatives, which documents have been filed by both parties, when matters are listed, if judgements or orders have been made and if any document or items have been requested by subpoena.
