Forms to respond to a case

The form you need to file depends on whether you agree or disagree with the claims. If you agree with the claims, seek legal advice to obtain the appropriate form, as it is not listed here.

Appearance (UCPR form 6)Information
If you were served with a Summons, Cross Summons or an Application Class 1, 2, 3 (LECR form B), you need to file an Appearance. You should note that there are time limits to filing an Appearance. These time limits are specified within the forms.

Defence (UCPR form 7A/7B)Information
If served with a Statement or Cross Claim, you need to file a Defence. To seek more details before drafting your Defence, ask the plaintiff. In some District and Supreme Court cases, your Defence must be verified by an Affidavit (a written statement sworn or affirmed before a witness). If required, you'll be prompted to upload an affidavit when completing the Defence form.

Garnishee's statement that no debt due or accruing or no wage or salary payable (UCPR 72)Information
If you are the named garnishee in a court order served on you, you can use this form to provide a statement that there is no debt due or accruing when the order was served on you (the garnishee), or that no wage or salary will become payable during the period the garnishee order is in force.

Notice of intended objection to accounts (UCPR 143)Information
If you have located a published notice of filing of accounts in an estate in which you have an interest, you can register your intention to object to the accounts application. You should note that there are time limits for filing this notice.

After you file a defence or appearance form
- Serve a sealed copy on any other person you have named in your case. A sealed copy will be sent to you via email after you file your form.
- Attend court on the date and time your case is listed. If you miss the hearing, the court may make a binding decision, including a costs order, against you in your absence.
